Overturned a ruling that awarded Massachusetts couple $5 million in damages for wayward tee shots

After filing a lawsuit against Indian Pond Country Club, a couple from Massachusetts was awarded almost $5 million for damage to their home due to their use of wayward tee shots.

Athina and Erik Tenczar purchased the house in 2017. They claimed that over 650 golf balls struck their house, resulting in broken windows as well as damage to the siding.

The ruling was overturned by the Massachusetts Supreme Judicial Court on Tuesday due to a “clear mistake” made by William M. White Jr., Superior Court Judge.

This error prevented the jury answering a crucial question about the case: Was the 15th hole of the course reasonably operated?

Judge Scott Kafker was part of the unanimous ruling. He stated, “With golf, some errors are inevitable but a predictable pattern errant shots that arise out of the unreasonable golf course operation”

sat down with Robert Galvin, an attorney who was trying to repress the couple.

Galvin stated that the family has no other option but to continue this. He also said that he believes we have proven what a jury made of this situation.
